1. Agreement to Terms

By accessing or using AI Email Generator ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

AI Email Generator (aigenemail.com) is an AI-powered tool that helps users create professional emails. The Service:

• Generates email content based on your input (type, recipient, subject, context, tone, length)
• Uses Google Gemini API (gemini-2.5-flash model) for AI generation
• Offers two tiers:
  • Free: 3 emails per day with watermark, limited email types (professional, thank-you, follow-up, introduction), limited tones (professional, friendly, formal)
  • PRO: Unlimited emails, no watermark, all 10 email types, all 5 tones, $9.99/month or $69.99/year
• Processes subscriptions securely through Stripe
• Shows blurred preview before payment (free tier) or instant access (PRO tier)
• Stores generated emails in temp_emails/ directory for 24 hours, then automatically deletes them
• No accounts required - completely anonymous usage
• Rate limiting: 60 requests per minute per IP to prevent abuse

3. User Requirements

To use the Service, you must:

• Be at least 16 years of age
• Provide accurate and complete information
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws

4. No Accounts Required

The Service does not require or offer user registration. Each email generation is an independent transaction. We do not collect or store your email address or create user profiles.

5. Payment Terms

5.1 Pricing

Free Tier:

• 3 emails per day
• Watermark included on generated emails
• Limited to 4 email types and 3 tones
• Resets every 24 hours

PRO Tier:

• Monthly Plan: $9.99 USD per month
• Annual Plan: $69.99 USD per year (save 42%!)
• Unlimited email generation
• No watermarks
• All 10 email types (professional, follow-up, thank-you, apology, introduction, request, invitation, resignation, cover letter, and more)
• All 5 tones (professional, friendly, formal, casual, persuasive)
• 4 quick templates

Prices are subject to change with 30 days' notice to existing subscribers.

5.2 Payment Processing

• All payments are processed securely through Stripe
• Subscriptions auto-renew until canceled
• We accept major credit and debit cards (Visa, Mastercard, American Express)
• Prices include all applicable taxes
• Currency: USD

5.3 Subscription Management

• Cancellation: Contact support@aigenemail.com to cancel your subscription. No penalty for cancellation
• Effective Date: Cancellation takes effect at the end of your current billing period
• No Refunds: We do not provide refunds for partial billing periods
• Access After Cancellation: You retain PRO benefits until the end of your paid period, then revert to Free tier
• Subscription Status: Check your subscription status and payment history in your Stripe customer portal (accessible via Stripe-sent emails)

5.4 Refund Policy

• Free Tier: No payment required, no refunds applicable
• PRO Subscriptions: We offer a 30-day money-back guarantee. If you're not satisfied within the first 30 days, contact support@aigenemail.com for a full refund
• After 30 Days: No refunds for remaining subscription time. Cancel to prevent future charges
• Technical Issues: If a technical error prevents service access, contact us at support@aigenemail.com with details. We'll extend your subscription or provide a refund at our discretion
• Chargebacks: Initiating a chargeback without contacting us first may result in service suspension

5.5 Free Trial and Promotions

We may offer promotional rates or trials from time to time. Specific terms will be disclosed at the time of offer. Promotional rates are limited to new subscribers unless stated otherwise.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use the Service for:

• Generating professional business emails
• Creating personal correspondence
• Drafting follow-up emails, thank you notes, etc.
• Any lawful purpose consistent with these Terms

6.2 Prohibited Uses

You may NOT use the Service to:

• Generate spam, phishing, scams, or fraudulent content
• Create harmful, threatening, harassing, or defamatory messages
• Generate content that violates any laws or regulations
• Create content that infringes on intellectual property rights
• Generate discriminatory, hateful, violent, or illegal content
• Attempt to reverse engineer, hack, or exploit the Service
• Automate requests, scrape data, or abuse the API
• Resell generated emails as a commercial service
• Use the Service to impersonate others or misrepresent your identity

Violation of these terms may result in immediate service termination and reporting to authorities if illegal activity is suspected.

7. Intellectual Property Rights

7.1 Generated Content

For both Free and PRO users:

• Usage Rights: You own the right to use the generated email content for any lawful purpose
• Modification: You may edit, modify, or adapt the content as needed
• Responsibility: You are solely responsible for reviewing, verifying, and ensuring the content is appropriate for your intended use
• Watermark (Free Tier): Free tier emails include a watermark footer. Remove it after upgrading to PRO or edit it out
• No Exclusivity: Similar emails may be generated for other users based on similar prompts

7.2 Service Content

All aspects of the Service, including but not limited to:

• Website design and layout
• Software and code
• Logos, trademarks, and branding
• Documentation and help materials

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

• Generated emails are automatically deleted after 24 hours
• We comply with GDPR and data protection regulations
• Payment data is processed securely through Stripe
• We use cookies for essential functionality

9. Disclaimers and Warranties

9.1 Service Provided "AS IS"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of generated content

9.2 AI-Generated Content Disclaimer

IMPORTANT: AI-generated content has limitations:

• May Contain Errors: Gemini AI may generate factually incorrect, grammatically imperfect, or contextually inappropriate content
• Your Responsibility: YOU must review, edit, and verify all content before using it
• No Guarantees: We do not guarantee that generated emails will achieve your desired results or be suitable for your specific needs
• Assistant Tool Only: The Service is a tool to assist your writing, not replace human judgment and responsibility
• Preview Before Purchase: Always review the blurred preview before paying to ensure the content is generally suitable

By using the Service, you acknowledge these limitations and accept full responsibility for any content you use.

9.3 No Guarantee of Availability

We do not guarantee that the Service will:

• Be available at all times without interruption
• Be error-free or secure
• Meet your specific requirements

10. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Maximum Liability: Our total liability shall not exceed the amount you paid in the 12 months preceding the claim (for PRO users) or $0 (for Free users)
• We are not responsible for any damages resulting from your use of generated emails
• We are not liable for third-party services (Stripe, Google Gemini API) or their availability
• We are not responsible for AI-generated content accuracy, suitability, or consequences of its use

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Email Generator and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your use of generated email content

12. Third-Party Services

The Service integrates with third-party services:

• Stripe: Payment processing governed by Stripe's Terms. We use Stripe Checkout for secure payment processing
• Google Gemini API: AI processing using gemini-2.5-flash model, governed by Google's Terms and Gemini API Terms

Your use of these services is subject to their respective terms and conditions. We have no control over third-party services.

13. Modifications to Service

We reserve the right to:

• Modify or discontinue the Service at any time
• Change pricing with reasonable notice
• Update features and functionality
• Impose limits on usage

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you:

• Breach these Terms
• Engage in prohibited activities
• Abuse or misuse the Service

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. For users in the EU/EEA, mandatory consumer protection laws of your country of residence apply.

15.2 Dispute Resolution

For users in the EU/EEA:

• You may resolve disputes through the EU Online Dispute Resolution platform
• Contact us first to attempt to resolve issues amicably

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Email Generator regarding the Service.

18. Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
